Birth Injuries
South Florida Birth Injury Attorneys
The birth of a baby can be a complicated process, with a very narrow margin for error. A minute delay in a critical period can make the difference between a healthy baby and catastrophe. Statistics suggest that injuries occur in as many as 27 of every 1,000 births in the United States; a great portion of which are the consequence of medical malpractice.
When these avoidable medical errors are committed, great harm is done to innocent newborn children. The injuries can include brain damage, spinal cord damage, paralysis, breech birth complications, bone fractures, infections, epilepsy and wrongful death. For those that survive, the injuries are almost always permanent and result in substantial medical bills, specialized treatment, and developmental problems. Some examples of the ways in which health care providers commit medical malpractice include leaving the baby in the birth canal too long, improper use of a medical instrument or the failure to timely perform a Cesareansection when the baby is in distress.
One of the most common birth injuries during delivery is shoulder dystocia, which occurs when the baby’s shoulders are too large for the birth canal and the infant becomes lodged behind the mother’s pubic bone. Complication from this can include:
- Cerebral Palsy: A condition in which brain damage affects body movement and muscle coordination. Cerebral palsy can occur with even the best medical care, but some cases result from medical negligence during deliveries.
- Erb’s palsy: A loss of mobility in the hand or arm. Erb’s palsy is often seen after difficult deliveries in which excessive pressure is exerted in an effort to free the child.
- Klumpke’s palsy: A trauma injury caused by excessive pressure to a baby’s neck or head during delivery that causes paralysis of the hand and wrist.
